How to apply for copyright of a work
Applying for copyright of a work requires following the following procedures:
1、 Submit works for copyright registration: Submit the works you want to apply for copyright registration to the National Copyright Administration.
2、 Entering the copyright registration process: The author or their agent shall submit the relevant application materials to the National Copyright Administration and fill out the copyright registration application form and copyright registration guarantee letter. If there are no objections after the review, the Copyright Administration will handle the registration and issue the work registration certificate within one month.
3、 Submit materials for applying for copyright registration:
(1) Original and photocopy of the applicant's ID card and work permit for copyright registration.
(2) Application for voluntary copyright registration of works.
(3) Copyright registration work description: mainly describing the content and creative process of the work.
(4) Original and photocopy of copyright registered works.
(5) Copyright registration rights guarantee letter.
4、 Payment of copyright registration fees: If the review is approved, the Copyright Bureau will issue a payment notice, and the applicant or agent needs to pay the corresponding copyright registration fees according to the requirements of the notice.
5、 Formal acceptance of copyright registration application: After the submitted copyright registration application meets the registration requirements and the corresponding application fees have been paid, the Copyright Bureau will officially accept it.
6、 Copyright registration review: After formal acceptance, the Copyright Bureau will conduct a series of standard reviews to see if there are any issues with the application or if it was submitted by the author themselves.
7、 Issuance of Copyright Registration Certificate: After the review is approved, the Copyright Bureau will issue the Copyright Registration Certificate within approximately two months.
Article 4 of the Trial Measures for Voluntary Registration of Works: Applicants for registration of works shall be authors, other citizens, legal persons or non legal entities who enjoy copyright, and exclusive rights owners and their agents.
Article 7 of the Trial Measures for Voluntary Registration of Works: The jurisdiction of the author or other citizens who enjoy copyright shall, in principle, be based on the jurisdiction of the address on their ID card. For co authors and those with multiple copyright owners, the jurisdiction of the journalist to whom the Toden belongs shall prevail. The jurisdiction of a legal or non legal entity shall be based on the jurisdiction of the place where its business premises are located.
Article 8 of the Trial Measures for Voluntary Registration of Works: Authors or other copyright owners applying for work registration shall provide identification or proof of ownership of the work rights (such as copies of the cover and copyright page, copies and photos of some manuscripts, samples, etc.), fill out the work registration form, and pay the registration fee. Other copyright owners applying for work registration should also provide proof of their identity (such as proof of inheritance for heirs, and a commission contract for commissioned works). The owner of the exclusive rights shall present a contract proving their ownership of the exclusive rights.
Article 9 of the Trial Measures for Voluntary Registration of Works: After the registered works are verified by the work registration authority, the work registration authority shall issue a work registration certificate. The work registration certificate shall be made by the registration authority according to the sample attached to these measures. The verification period of the registration authority is one month, which is calculated from the date when the registration authority receives all the application registration materials submitted by the applicant.
